Terms of Service
The parties to this agreement are Waltr Technologies (Kre38 Labs Pvt. Ltd.) as the Service Provider and the customer as the User. The terms of the service agreement are as follows:
1. Scope of Service
This agreement governs the purchase, installation, and ongoing use of covr smart water tank lid devices and associated services accessed via tankcovr.in or the covr mobile app.
The covr device will be installed at the address provided by the User during purchase. The Service Provider is responsible for ensuring the device functions as described throughout the warranty period.
2. Device Ownership
Upon full payment, ownership of the covr device transfers to the User. The User is responsible for the safe keeping of the device from the point of delivery.
In no case shall the User move or reinstall the device at a different location without notifying Waltr Technologies. Unauthorized relocation may void applicable warranties and support entitlements.
3. Delivery
On successful order and payment, the Service Provider shall deliver the device to the User at the address provided during checkout.
The User or their representative must be present at the scheduled delivery date and time. Additional delivery charges may apply if no one is available to receive the order.
The User shall inspect the device at the time of delivery. Once accepted, no returns are permitted except as specified in the Warranty and Replacement Policy.
The User must ensure that appropriate access and permissions are available for installation where applicable.
4. Payment
Full payment is due at the time of purchase via the payment options available at checkout.
If the User opts for EMI, payments are governed by the terms of the selected payment partner.
Applicable taxes are included in the displayed price. No additional charges will be levied post-purchase.
In case of any additional or optional services requested post-purchase, the same will be billed separately inclusive of applicable taxes.
5. Care of Device
The User must use the covr device in a careful and proper manner, consistent with the instructions provided in the product manual and documentation on tankcovr.in.
6. Maintenance and Support
Waltr Technologies will provide remote support and software updates throughout the warranty period at no cost. In case of any malfunction reported by the User, the Service Provider shall assess and address the issue within 5 working days.
The Service Provider shall not be responsible for repairs or replacements necessitated by:
Misuse, misapplication, negligence, alteration, or accident
Operation contrary to product instructions
Incompatibility with third-party accessories not approved by Waltr Technologies
Repairs performed using components not supplied or approved by Waltr Technologies
Damage caused by suspended matter, biological growth, or precipitates in the tank or its environment
7. User Liability
In case of permanent damage due to User negligence, loss, or theft of the device — regardless of cause — the User agrees to bear the cost of replacement at fair market value as determined by Waltr Technologies.
The User also agrees to bear costs including but not limited to:
Loss, damage, or diminution in value of the device caused by User actions
Administrative and legal fees associated with processing claims
All fines, penalties, or expenses relating to the device arising from User actions
8. Indemnification and Liability
Waltr Technologies shall not be liable for any indirect, special, or consequential damages arising from the User's use of the covr device, including but not limited to loss of profits or revenue.
The User agrees to indemnify and hold Waltr Technologies harmless from claims, demands, or causes of action arising from the User's misuse of the device.
9. Termination of Service
This agreement may be terminated in the following cases:
User discontinues use and the device is deactivated
Non-payment for additional services or EMI installments
Mutual agreement by either party with prior notice
Loss or permanent damage to the device
10. Governing Law and Jurisdiction
This agreement shall be construed and interpreted in accordance with the laws of India. Courts in Bengaluru alone shall have jurisdiction to try any dispute arising out of this Agreement.
11. Severability
If any provision of this agreement is held to be unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
12. Entire Agreement
This agreement represents the entire understanding relating to the subject matter hereof and prevails over any prior or contemporaneous, conflicting, or additional communications. This agreement can only be modified by a written amendment signed by the party against whom enforcement is sought.
13. Force Majeure
Waltr Technologies shall not be held responsible for failures resulting from events beyond its reasonable control, including but not limited to floods, earthquakes, storms, transportation strikes, or labour disputes.
